This letter to instruct the contractor to remove the above-mentioned employee arises from violating the excavation and underground utility protection procedure by damaging the live foul sewer by mechanical excavation using an excavator. Wet utility engineer (or relevant position) Mr. (name of violator) assigned a team to perform the excavation without a valid permit and failed to perform an inspection to identify the underground utilities nor he briefed the workers about the precautions while working near and on the live buried utilities. He is found violating their procedure for the preventing and protection of underground utilities. Which led the damage of (specify service damaged e.g. diameter sewer foul water lane) and public services interruption.

After critical analysis and investigation of the above incident by (your organisation or department), it is confirmed that Mr. (name of violator) had directly involved and supervised the team to use the excavator in the close vicinity of live exposed foul sewer line and damaged it. 

(your organisation or department), along with the client project leaders have concluded that the above employee had violated the underground utility protection procedure requirement and there is no reasonable excuse for such an intentional act and this conduct are unsatisfactory. The contractor is accordingly instructed to immediacy remove Mr. (name of violator) from the project for the reason stated above and confirm back to the (your organisation or department), within 3 days for this latter.
